Terms of Service

1. Acceptance

By creating an account or using Mutual Clarity ("Service") you agree to these Terms.

2. Eligibility

The Service is intended for licensed mortgage professionals and their prospective clients. You represent that you have the legal authority to enter these Terms.

3. Not a lender; no advice

Mutual Clarity is a software tool. We are not a lender, broker, financial advisor, tax advisor, or law firm. Presentations generated by the Service are for educational and illustrative purposes only and are not loan approvals, loan estimates, commitments to lend, financial plans, tax advice, or legal advice.

4. Your content

You retain ownership of the client information and presentations you create. You grant us a limited license to host, process, and display that content solely to operate the Service.

5. Acceptable use

  • Do not use the Service to violate law or third-party rights.
  • Do not attempt to reverse engineer, disrupt, or circumvent security of the Service.
  • Do not upload malicious code or content you do not have rights to.
  • You are responsible for the accuracy and compliance of the content you publish.

6. Accounts and security

You are responsible for safeguarding your credentials and for activity under your account.

7. Fees

The Service is currently offered free of charge during our beta period. We may introduce paid plans in the future; we will provide notice before charging you.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUTUAL CLARITY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM (OR $100 IF NONE).

10. Indemnification

You will indemnify and hold Mutual Clarity harmless from claims arising from your content or your violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms.

12. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law rules.

13. Changes

We may update these Terms; material changes will be indicated by updating the "Last updated" date.
